How Do Bail Bonds Work?

A bail bond is a service fee for putting up bail money to a court in order to allow you to get out of jail until your court date. The court will set a bail amount for you, if it is more than you can afford and you don’t want yourself or your loved one to remain in jail until that court date, then you need to talk to a bail bonds company who will put the money up on your behalf.

About

What Happens If I Am An Indemnitor (Co-Signer) For A Bail Bond?

Co-signing for a bail bond means you are taking legal responsibility for the full amount of the bail bond. So if the court said the bail bond was $10,000, and the bail bondsman is asking you to pay $1,000 to them as their service fee, and the person skips out and runs from the appointed court date, the bondsman will come after you to get the money they put up to the court, which means you owe the full $10,000.

Bail Bonds in Arkansas City, KS

We are a bail bond company based in Wichita at 700 N Market St, Ste 1, and the office is staffed around the clock. We do not keep an office in Arkansas City. What we do is travel down to Cowley County and write the bond in person, the same way we do in Sedgwick County. Where someone arrested in Arkansas City is held

Arkansas City does not have a county jail. Cowley County runs one jail, and it is in Winfield, about a half hour north of Ark City.

The Cowley County Jail is operated by the Cowley County Sheriff’s Office at 911 Fuller, Winfield, KS 67156. The Sheriff’s Office numbers are 620-221-5444 and 620-441-4555, with office hours listed as 8 a.m. to 5 p.m. The current sheriff is Dave Falletti.

The jail itself is newer than most in the area. Cowley County voters approved a sales tax in 2005 to build it, it opened in 2008 and was finished in 2009, and it replaced an older facility with a recommended capacity of 38. The current building is a 220 bed facility with core systems built to handle up to 400 if the county ever needs to expand. The county uses NCIC Inmate Communications for inmate visitation and messaging, which families can access through the NCIC app on iOS or Android or through a computer.

So if your person was picked up on Summit Street in Arkansas City, they are almost certainly sitting in Winfield by the time you are reading this.

Cowley County has two courthouses, and that is unusual

Most Kansas counties have one district court in one county seat. Cowley County has district court locations in two towns, and which one your case lands in matters for where you have to show up.

  • Winfield: Cowley County Courthouse, 311 E 9th Ave, Winfield, KS 67156. Phone 620-221-5470. Hours are listed as 8 a.m. to noon and 1 p.m. to 4 p.m.
  • Arkansas City: the district court sits on the second floor of the Arkansas City municipal building, the City Hall building at Central Avenue and 1st Street. Phone 620-441-4520. Same hours, 8 a.m. to noon and 1 p.m. to 4 p.m.

Cowley County is the entire 19th Judicial District, meaning it does not share judges with neighbouring counties the way Sumner or Butler County does. The chief clerk of the district court is Cheryl Wilson. The main Cowley County Courthouse line is 620-221-5400, Monday through Friday 8 a.m. to 5 p.m.

City charges stay in Arkansas City

If the ticket or charge came from an Arkansas City police officer and it is a city ordinance or city traffic matter, it goes to Arkansas City Municipal Court, not to district court.

  • Arkansas City Police Department: 117 W Central Ave, Arkansas City, KS 67005, phone (620) 441-4547.
  • Arkansas City Municipal Court: 118 W Central Ave, Arkansas City, KS 67005. The municipal court clerk is Andrea Potter at (620) 441-4408. Clerk’s office hours are Monday through Friday, 8 a.m. to 5 p.m.
  • Court schedule: the city states that municipal court runs on Tuesdays, with the payment docket from 1:00 p.m. to 3:00 p.m., arraignments at 1:30 p.m. and trials at 2:30 p.m.
  • City main line: 620-441-4400. Fine payments can be made at the Finance Office across the hall, by phone, or online.

The police department at 117 W Central and the municipal court at 118 W Central are directly across the street from each other, which trips up people who are told to go to “the building on Central” and end up in the wrong one.

How we handle a Cowley County bond from Wichita

Here is the actual sequence, so there are no surprises.

  • You call and we locate them. Give us the full legal name and, if you have it, the date of birth. We confirm they are in the Cowley County Jail and what the bond is set at. If booking is not finished yet, the bond may not be set, and we will tell you that plainly instead of stringing you along.
  • We go over the numbers. You will know the fee, what we can take as a down payment and what the balance looks like before you agree to anything. We put it in writing.
  • Paperwork gets signed. Most of this can be handled electronically, which matters when you are in Wichita or Oklahoma and your person is in Winfield. If it has to be in person, we come to you.
  • A bondsman travels down and posts the bond. Winfield is a straight run south of Wichita, and we make that drive.
  • The jail processes the release. Once the bond is posted the timing belongs to the jail, not to us. It is usually reasonably quick, but a shift change or a backed up booking area can stretch it, and no honest bondsman will promise you a minute count.

What to have ready when you call

  • Full legal name as it appears on their ID, and date of birth
  • Which agency arrested them: Arkansas City Police, Cowley County Sheriff, Winfield Police, or the Kansas Highway Patrol
  • The bond amount, if it has been set
  • Your own ID, address, and how long you have lived there
  • Where you work and a daytime phone number
  • A second person who knows them and can reach them

If you do not have all of it, call anyway. Locating your person and confirming the bond is the first thing we do, and we do it before anyone talks about money.

How bail works, in plain terms

The judge sets a bond amount. That is the money the court holds to make sure your person comes back to court. You can pay the full amount to the court in cash, which you get back at the end of the case if every court date is met, or you can go through a bail bond company, which charges a fee to post the bond on your behalf.

The fee is what you pay for the service. It is not a deposit and it is not refunded when the case ends. That is how it works at every bail bond company in Kansas. The exact fee and payment terms depend on the bond amount, the charge and the county, so we quote it on the call instead of posting one number that may not apply to your situation.

Before you co-sign

Co-signing means you take on responsibility for the full bond amount if your person misses court. Two honest questions before you sign: will this person show up, and can you stay in contact with them until the case is finished? Most bonds that go bad go bad because somebody lost track of a court date, not because somebody ran. If you co-sign, write every date down and make sure they get there.
