How Do Bail Bonds Work?

A bail bond is a service fee for putting up bail money to a court in order to allow you to get out of jail until your court date. The court will set a bail amount for you, if it is more than you can afford and you don’t want yourself or your loved one to remain in jail until that court date, then you need to talk to a bail bonds company who will put the money up on your behalf.

About

What Happens If I Am An Indemnitor (Co-Signer) For A Bail Bond?

Co-signing for a bail bond means you are taking legal responsibility for the full amount of the bail bond. So if the court said the bail bond was $10,000, and the bail bondsman is asking you to pay $1,000 to them as their service fee, and the person skips out and runs from the appointed court date, the bondsman will come after you to get the money they put up to the court, which means you owe the full $10,000.

One jail for the whole county

The Harvey County Detention Center is operated by the Harvey County Sheriff’s Office out of the Law Enforcement Center at 120 E 7th St, Newton, KS 67114. The Sheriff’s Office line is (316) 284-6960. The sheriff is Chad Gay.

Newton, Hesston, Halstead, North Newton, Burrton, the Harvey County side of Sedgwick, and every county road in between all book into this one facility. There is no second jail to check.

What the county states directly:

  • Charges and the bond amount are obtained by contacting Detention Center staff. Until booking is complete there may be no bond amount to give you.
  • A bond can be paid in cash for the full amount, or posted through a bonding agent.
  • Inmate visitation is handled by video conferencing through Prodigy rather than in person.

A detail that saves people a trip: the Harvey County Sheriff’s Office, the Harvey County Detention Center and the Newton Police Department are all in the same Law Enforcement Center at 120 E 7th St. A city arrest and a county arrest in Newton end up at the same address.

Harvey County District Court

Felonies and county filed misdemeanors go to Harvey County District Court, on the second floor of the Harvey County Courthouse at 800 N Main St, Newton, KS 67114. The number is (316) 284-6800 and the mailing address is PO Box 687, Newton, KS 67114.

Harvey County is part of the Ninth Judicial District, which also covers McPherson County. Judges work across both counties, so the docket in Newton is not the same every week and a first appearance is scheduled around that calendar rather than around when your family is ready for it.

The municipal courts, town by town

City ordinance violations and city traffic charges do not go to the county. They stay with the town that wrote them, and several of these courts sit only once or twice a month. That is the single biggest reason a Harvey County family ends up needing a bond.

  • Newton Municipal Court: 201 E 6th St, Newton, KS 67114, phone 316-284-6050, open Monday through Friday 8 a.m. to 5 p.m. Newton Police are at 120 E 7th St, main line 316-284-6030, non emergency dispatch 316-283-4190.
  • North Newton Municipal Court: 2601 N Main, North Newton, KS 67117, phone 316-283-7633. The city states the court convenes at 4:00 p.m. on the first Thursday of each month. North Newton Police are at the same address, chief Jim Bethards.
  • Hesston Municipal Court: 110 E Smith St, Hesston, KS 67062, phone (620) 327-2020. Judge Randy Pankratz, clerk Janet Thrasher. Hesston Police are at 115 E Smith St, (620) 327-4412, with office hours Monday through Thursday 7:30 a.m. to 5:00 p.m. and Friday mornings only.
  • Halstead: city offices at 303 Main St, Halstead, KS 67056, 316-835-2286. Police chief Josh Orem, 316-835-2266. Municipal judge Randall Pankratz, 316-283-8746.
  • Sedgwick: Sedgwick Municipal Court at 505 N Commercial, Sedgwick, KS 67135, (316) 416-4041. The city states court is held at Sedgwick City Hall on the first Wednesday of each month at 4 p.m.

Read those schedules again. Two of these courts sit once a month. If your person is in custody on a city charge and the docket has just passed, waiting is not a neutral choice. It is weeks.

The Sedgwick county line problem

The city of Sedgwick sits in both Harvey County and Sedgwick County. An arrest there can end up at the Harvey County Detention Center in Newton or at the Sedgwick County Adult Detention Facility at 141 W Elm in Wichita, depending on which county the arrest happened in and which agency made it.

If you have called one jail and been told there is no record of your person, that split is usually the explanation. We check both.

How we handle a Harvey County bond

  • You call and we locate them. Full legal name and date of birth if you have it. We confirm the facility and the bond amount.
  • We work out which court it is. A city charge and a county felony go in completely different directions.
  • We go over the numbers. Fee, down payment, balance, in writing, before you agree to anything.
  • Paperwork gets signed. Most of it electronically. If you would rather do it in person, we come to you.
  • A bondsman travels up and posts the bond. Newton is a straight run north of Wichita on I-135.
  • The jail handles the release. After the bond is posted the timing is theirs. Usually reasonably quick, sometimes slowed, and we will not quote you a minute count we cannot control.

What to have ready when you call

  • Full legal name as it appears on their ID, plus date of birth
  • Which agency arrested them, and which town
  • The bond amount, if it has been set
  • Your own ID, your address, and how long you have lived there
  • Where you work and a daytime phone number
  • A second contact who knows them

What a bond costs

The court sets the bond amount. We charge a percentage of that as our fee and in most cases can start from a down payment rather than the whole fee up front. Terms depend on the bond amount, the charge and the county, so we quote you on the call instead of publishing one number that may not fit. The fee pays for posting the bond. It is not a deposit and it is not refunded when the case ends.
