What Happens If A Person Skips Bail?

If a person skips bail meaning they fail to appear in court after being released they face serious legal and financial consequences. Skipping bail violates court orders, leads to arrest warrants, and can cause the loss of all bond money or collateral. It also damages credibility in court and makes future release much more difficult.

Immediate Consequences

When someone misses a court date while out on bail, the judge immediately issues a bench warrant for their arrest. This means law enforcement can arrest them at any time and return them to jail. The court also revokes the person’s bond, meaning they lose their right to remain free while awaiting trial.

  • Bench warrant – Allows police to arrest you immediately.
  • Bond revoked – You lose the privilege of release and must stay in jail until trial.

Financial Penalties

Skipping bail leads to bond forfeiture. If the person paid a cash bond, the entire amount is kept by the court. If a bail bondsman posted the bond, they must pay the full amount to the court, and the defendant or whoever co-signed becomes responsible for repaying that money.

  • Cash bond – The full bail amount is lost to the court.
  • Bail bond – The bondsman pays the court and collects repayment through collateral or legal action.

New Criminal Charges

Skipping bail is a separate criminal offense called failure to appear. In Kansas and many other states, this can lead to additional charges that increase penalties.

  • For a misdemeanor case – Up to one year in jail and new fines.
  • For a felony case – A new felony charge that can add several years to your sentence.

Bounty Hunters & Recovery Agents

If a person skips bail after using a bail bondsman, the bondsman can hire a bounty hunter (also called a recovery agent) to locate and arrest the defendant. Bounty hunters are legally allowed to track, detain, and return defendants to custody in most states.

  • Bondsmen use bounty hunters to avoid losing money on forfeited bonds.
  • The defendant’s co-signer may also lose property or valuables put up as collateral.

Impact on Future Bail

After skipping bail, it becomes very difficult to secure release in future cases. Judges are less likely to grant bail again, or they may set much higher amounts. The defendant’s credibility is permanently damaged, and any previous bond agreements are voided.

How to Fix a Missed Court Date

If you miss court unintentionally, you can sometimes fix the situation before things get worse. Contact your lawyer or the court immediately to explain what happened. If you appear voluntarily and provide a valid reason such as illness or emergency the judge may recall the warrant and reinstate your bond.

Skipping bail leads to arrest, loss of bond money, and new criminal charges. It’s always better to communicate with the court or your attorney immediately if you can’t make a scheduled hearing to avoid severe legal consequences.
